These Terms & Conditions ("Terms") govern your use of Day1 Ops phone and text messaging services operated by Day1 Holdings on behalf of local service businesses. By calling or texting a business number that uses Day1 Ops, you agree to these Terms.

Service description

Day1 Holdings operates Day1 Ops, a lead-response and communication automation service. When you contact a participating business by phone or text, our systems may:

Day1 Holdings is the technology provider behind Day1 Ops. The local service business — not Day1 Holdings — is responsible for performing the actual service work, scheduling, pricing, and customer support for their trade or profession.

Consent to receive text messages

You consent to receive service-related text messages when you:

We do not send unsolicited marketing texts to numbers that have not called or texted us. Message frequency varies. Message and data rates may apply.

Opt-out

Reply STOP at any time to cancel text messages from the business number. Reply HELP for assistance. After opting out, you may still contact the business by phone. A new call or inbound text may restart service-related messaging for that inquiry.

Acceptable use

You agree not to use the messaging service to:

We and the business may suspend messaging for numbers that violate these Terms or applicable law.

No emergency service

Text messaging and automated call handling are not suitable for emergencies. If you have an emergency — for example, active flooding, gas leak, fire, or medical emergency — call 911 or your local emergency number immediately. Do not rely on SMS for urgent safety matters.

Disclaimer of warranties

The service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted delivery of calls or texts, and carriers may delay or block messages outside our control.

Limitation of liability

To the fullest extent permitted by law, Day1 Holdings will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the messaging service. Our total liability for any claim related to the service is limited to the amount you paid us directly for that interaction, if any, or one hundred U.S. dollars ($100), whichever is greater.

Changes

We may update these Terms from time to time. The "Last updated" date above indicates the current version. Material changes will be reflected on this page.

Governing law

These Terms are governed by the laws of the United States and the state in which Day1 Holdings is organized, without regard to conflict-of-law rules.
